Understanding NGO Registration in India
An NGO (Non-Governmental Organization) is a voluntary entity formed for charitable, social, educational, or religious purposes.
It can be registered under different laws depending on its structure and objectives.
There are three main legal structures for NGOs in India:
1. Trust
Registered under the Indian Trusts Act, 1882, a Trust is created by the founder (Settlor) for charitable or religious purposes.
Best suited for: family-run or small-scale charitable organizations.
2. Society
Registered under the Societies Registration Act, 1860, a Society is a membership-based organization that works for public welfare, education, or cultural promotion.
Best suited for: educational institutions, welfare organizations, and community service groups.
3. Section 8 Company
Registered under Section 8 of the Companies Act, 2013, this structure is for entities working toward charitable objectives while maintaining a corporate framework.
Best suited for: large NGOs seeking foreign funding, credibility, and structured management.
